Status Report 10/16/12


Appeal Hearing:


The Appeal Court has scheduled our hearing For Nov. 20, 10:00 am at 350 McAllister St., fourth floor, San Francisco, CA.  Dov Grunschlag will be presenting our oral argument. The scheduling notice has been added to the information archive on our website under legal filings.


Tom suggests that it would be helpful if we could round up some retirees who would like to attend.  Typically, there are 10-20 cases on the calendar.  We may find out in advance where we are on the schedule but it can change, even on the day set for argument.  If you think you might want to attend, please let me know by Nov. 9.


Tax Exempt Status:


Now that we have filed our 990 forms with the IRS, they want more than $5,000 in late fees. The fees can be forgiven if we can show they misled us. We have filed to have them forgiven.


 We initially filed the 2009 form on time and the IRS sent back a letter saying the form wasnÕt due until after we received their determination letter. We sent back a letter saying to discard the filing and we would refile after we received our letter. We believe that should be sufficient reason to cause them to forgive the fees.
